I am advised that if someone is considering returning home, it is important to remember the decision to return is theirs. We do accept that it is not always an easy decision to make. However, Australia does not return failed asylum seekers who are found not to be refugees where this would contravene Australia's non-refoulement obligations under other human rights instruments.
